is Maemo 5 , available for download for our Nokia N810 ?

Maemo 5 won't be available for N8x0 nor N770. Several Maemo 5 features
aren't supported in that hardware, or would be unusable.

Take a look at Mer, however, http://wiki.maemo.org/Mer, which intends
to keep supporting that devices, besides several others.
